Under IRPR 87.1(3)(b), periods of self-employment are not counted as Canadian work experience for Express Entry purposes.
So, when are you considered self-employed?
Business owners and co-owners are generally viewed as self-employed because there is no true employer–employee relationship. A business owner cannot formally hire or dismiss themselves or their co-owners. Co-owners act as shareholders and directors rather than employees.
Self-employed individuals typically control their own work and business operations, which differs fundamentally from working under the direction of a third-party employer.
If an applicant is unsure about their employment status and lacks clear supporting documentation, they may request a ruling from the Canada Revenue Agency (CRA). Such a ruling may indicate how the CRA views the working relationship. However, it is important to understand that IRCC officers make the final determination, and CRA rulings are not considered conclusive evidence for immigration purposes.
A job title alone is not sufficient.
NOC 00 does not apply to just any managerial role. It is intended for senior leaders who manage managers — individuals whose direct reports themselves supervise teams or professional functions.
To demonstrate genuine senior management experience, applicants should typically show:
Multiple layers of management within the organization
At least two direct-report managers responsible for separate functional areas (such as Operations, Finance, Sales, or Engineering)
Evidence that those managers oversee professionals or technical staff
In other words, the organizational hierarchy and functional scope must be real, documented, and supported by evidence.
Eligibility also depends on whether the overall employment situation reflects a true senior management role. Applicants should demonstrate:
Experience in both management and middle-management roles leading up to senior leadership
Compensation that is reasonable and consistent with senior management positions in the industry
A company with sufficient financial capacity to pay that salary
A legitimate business need for a senior manager at that level within the organization
IRCC officers assess whether the role genuinely exists as described, not simply whether a title was assigned.
Ensuring that your claimed work experience genuinely meets regulatory requirements is very important. Careful preparation and accurate classification can make the difference between approval and refusal.
